Mobile Content Services

 

To address the public concerns on charging disputes related to Mobile Content Service (MCS), the Communications Association of Hong Kong (CAHK) issued an industry code entitled "Code for the Provision of Chargeable Mobile Content Services" PDF format - best viewed with the latest version of Acrobat reader (the Code) on 11 January, 2010.

The Administrative Agency (AA) was officially set up on Mar 31, 2010 by CAHK to (i) assess Content Service Providers' (CSP) capability of and securing their pledges in complying with the relevant requirements stipulated in the Code and (ii) monitor the CSPs' continual compliance with the Code. OFTA and CAHK have entered into a Memorandum of Understanding setting out the role and responsibilities of each party with regard to the establishment of the AA, the functions of the AA and the support to be given by CAHK with regard to the AA.

The Code provides that a CSP shall obtain from the AA a letter of positive assessment (LPA) certifying that the CSP is capable of complying and has pledged to comply with the relevant requirements of the Code. With effect from 1 June 2010, all CSPs need to apply for the LPA issued by AA before entering into a commercial contract with a Mobile Network Operator or Mobile Virtual Network Operator to procure delivery and billing services in respect of the MCS.
